The purpose of this Solicitation is to request competitive proposals from eligible experienced agencies to identify, track, collect, and grade the quality of codified city and county tobacco prevention policies, and to maintain the Policy Evaluation Tracking System (PETS) information about policy provisions, jurisdictions, dates of passage, and policy scores. The selected Contractor will track and collect policies from all jurisdictions (county and city) in the state of California on an ongoing basis. 

The successful Contractor will:
•    Develop a PETS Plan for data collection methods, grading, analysis, and reporting, including staff roles and responsibilities;
•    Create and maintain a PETS Advisory Committee comprised of California Department of Public Health (CDPH), California Tobacco Prevention Program (CTPP)-funded local projects and other local policy experts;
•    Identify and collect tobacco prevention policies from all California city and county jurisdictions;
•    Develop and revise grading rubrics as needed and conduct legal analysis of tobacco prevention policies adopted by county and city governments for the purposes of coding policy characteristics;
•    Review and grade the strength of tobacco prevention policies in comparison to model ordinances;
•    Prepare and deliver recorded tutorials about using PETS information; 
•    Respond to technical assistance requests from CDPH/CTPP, CDPH/CTPP-funded-agencies, and other tobacco prevention stakeholders.

The following entities and organizations are invited to apply for this Solicitation:

1.    Organizational Type and Conditions
Any public or private entities with a permanent place of business in California or that are qualified through the Secretary of State to do business in California are eligible to apply for these funds. Agencies claiming private non-profit status must submit proof of their non-profit status with their proposal. Either certification from the State of California, Office of Secretary of State, or a letter from the Department of Treasury, Internal Revenue Service (IRS) classifying the agency as a non-profit agency is acceptable proof. 

Agencies must be able to certify that no conflict of interest with commercial tobacco, e-cigarette, cannabis, or related industries exist. 

Agencies must also be able to provide a State of California Franchise Tax Board Entity Status Letter to certify that they are in good standing, fiscally stable, and qualified to conduct business with the State of California. 

By submitting a proposal, agencies acknowledge and agree to comply with all terms and conditions in the Solicitation. Any costs incurred by those participating at any stages of this Solicitation are the sole responsibility of the Proposer and will not be reimbursed by CDPH/CTPP.

2.    Required Experience
Key Personnel, Subcontractors, and/or Consultants should collectively demonstrate the following: 

•    At least five (5) years of identifying, tracking, analyzing, and grading public health policies at local, state, or national levels;
•    At least five (5) years of developing public health policy rubrics and conducting public health policy review and analysis;
•    At least three (3) years of providing technical assistance on policy analysis to public health stakeholders;
•    At least three (3) years of managing advisory boards; 
•    At least five (5) years of managing statewide projects with a budget of $700,000 per year or greater.

It is anticipated that up to $700,000 per year (12 months) will be available for the contract term. The estimated total contract amount is $3,500,000. The actual contract award may be lower than the anticipated available funding. Funding is contingent upon available revenues, appropriation by the Legislature and the Governor, multi-year spending authority, and CDPH funding priorities and/or legal or administrative limitations.
